There has been a lot of buzz recently about the RIAA. You may ask who is the RIAA? The answer is the Recording Industry Association of America. Why do I care about this association you may ask? Well, these guys carry around all the joy and vengeance that you would expect if you happened to piss off the CIA. Not only did they just sue 261 individual file-sharers without sending a warning last month, but they just sent out an additional 204 sternly worded letters giving the individuals 10 days to contact the RIAA to discuss a settlement and avoid being formally sued. The letter states:
"We are counsel to a group of companies that intend to file a lawsuit against you shortly for copyright infringement. We have gathered substantial evidence that you have been using a peer-to- peer network such as Kazaa or Gnutella to download and upload music owned by our clients.' '
Under copyright law, the defendants could face damages that range from $750 to $150,000 for each illegal song. [ See a list of usernames and ISPs ] being targeted by the RIAA for music piracy, or link to the EFF' s searchable database of subpoenas. Find out how to avoid a suit.
Well you may ask, “how does that affect the bedroom composer?” or “Why should I fear them?” Well you would be surprised what big money people will do after experiencing a 31 percent decline in CD sales in the United States in the past three years. (Although they neglect to think that it may be due in part to factors such as the slow economy and competition from DVDs, video games and other forms of entertainment, as well as bad music.) These cats want to raid your computer like you' ve got Elian Gonzalez hiding in there. I’m serious! [ Here’s an excerpt ] from an article in “Wired”
“It' s no joke. Lobbyists for the Recording Industry Association of America (RIAA) tried to glue this hacking-authorization amendment onto a mammoth anti-terrorism bill that Congress approved last week. A copy of an RIAA-drafted amendment obtained by Wired News would immunize all copyright holders -- including the movie and e-book industry -- for any data losses caused by their hacking efforts or other computer intrusions ' that are reasonably intended to impede or prevent' electronic piracy."
As you can see, their scope is expanding. This is not a hill worth dying on. I’m in the process of removing unlicensed samples. As a result, this festive month of “all hollows eve” will be the last you can download what is destined to be a cult classic; “Poe Raven con Walken”. This one I am self editing because I do not have any permission to use Christopher Walken, nor do I personally know him to get his approval. This way I can say that I survived the RIAA. I encourage others to do self editing and “Thin the herd” so to speak to make it easier on Josh and crew to getting sectionz.com to be the one-stop-shop for labels to pick up artists and not have any nasty lawsuits over – well – you know...
